These Terms of Service (“Terms”) govern your access to and use of the floodresiden.store website, including any related content on our California Flood Resilience Assessments blog, and any features that let you request consultative services (collectively, the “Services”). By using the Services, you agree to these Terms.
All blog content and materials provided through the Services are for informational purposes only. They do not constitute legal advice, regulatory advice, or insurance advice. Reliance on any information is solely at your own risk. We do not guarantee results, and no content should be treated as a substitute for advice from a qualified professional licensed in your jurisdiction.
Any assessments, recommendations, or consultative guidance are not a guarantee of any particular outcome, performance, or compliance result. Actual outcomes depend on many factors beyond our control, including site conditions, third-party actions, and applicable laws and standards.
If you request consultative services, we may contact you to discuss your needs. We may decline requests. Any deliverables are subject to the scope agreed with you at the time of request (for example, by email or other written communication).
To the maximum extent permitted by law, floodresiden.store and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Services.
Our total liability for any claim arising out of or related to the Services will be limited to the amount you paid to us for the applicable consultative request, if any. Some jurisdictions do not allow certain limitations, so the above may not fully apply to you.
Where return/refund rights apply, you must review the applicable terms provided to you at or before payment (including any eligibility timelines and limitations). If a refund/return policy is offered for a service purchase, it will be communicated clearly to help you understand eligibility. To the extent refunds/returns are subject to timing or limits, those rules apply (see Civil Code § 1723).
If we sell services online in California and you pay online, we disclose the legal name of the business, any applicable return/refund policy, and the complete street address from which the business is actually conducted at or before payment, subject to limited exceptions (see Business and Professions Code § 17538).
If we use a private mailbox receiving service or post office box for communications, any advertising and promotional materials will disclose the legal name and complete street address from which the business is actually conducted, with related acknowledgements as required (see Business and Professions Code § 17538.5).
If we experience a qualifying security breach of computerized personal information, we will disclose the breach to affected California residents as required by applicable law and timing/manner requirements (see Civil Code § 1798.82).
Our privacy practices, including how we handle personal information, are described in our Privacy Policy. If we collect personally identifiable information from California consumers, we will conspicuously post and comply with our Privacy Policy as required (see Business and Professions Code §§ 22575-22579). For covered businesses, our Privacy Policy and any required Notice at Collection and opt-out mechanisms (including rights relating to sensitive personal information where applicable) are also provided as required (see Civil Code § 1798.100, Civil Code § 1798.121, Civil Code § 1798.135).
You agree not to misuse the Services, attempt to interfere with or disrupt operations, or use the Services for unlawful purposes. You also agree not to violate any applicable laws or third-party rights.
We may update these Terms from time to time. The “Last updated” date will reflect the most recent changes. Continued use of the Services after changes become effective means you accept the updated Terms.
These Terms are governed by the laws applicable in California to the extent permitted by law, without regard to conflict-of-law rules.
